On June 30, 1864, President Abraham Lincoln signed a bill granting Yosemite Valley and the Mariposa Grove of Giant Sequoias to the State of California as an inalienable public trust.

Yosemite National Park Fire Update 6-29-09

The Grouse and Harden fires in Yosemite National Park have resumed growing after several inactive days due to rain and cloudy, cool conditions. Now that a high pressure system has returned with high temperatures and low humidity, activity has increased on the fires. Personnel are actively managing the fires to achieve specific protection and resource objectives.

Depending on weather and fuel conditions, ignition of the prescribed burn is expected from June 29 through mid July, 2009. Once ignited, the prescribed burning is expected to continue for several days. Burning is contingent on weather, fuel moisture, and air quality.

Constitutional convention effort comes to Fresno

Kevin Cann, a Mariposa County supervisor, worried that convention delegates could potentially come up with a system even worse than the current one. "The important thing is to zero in on what are some of the root causes of the problems," he said. "If we just go into an open-ended constitutional convention, it will just open the door to special interests."

The second reported accident came in during the evening hours from Yosemite Oaks Road near the 140 where two motorcycles were down on the ground with minor injuries to the riders.
Animal cruelty was reported on Peg Leg Road.
At 1:30 in the morning hours a barking dog on Carleton Road was keeping the neighbors from having peaceful dreams.

As the League convened its June policy committee meetings in Sacramento, across the street at the Capitol, the Assembly passed, but the Senate halted, three bills intended to keep the state from having to issue IOUs. Yosemite National Park - Rescued Park Visitors Return to Yosemite to Present Plaque to Park Ranger

Park visitors James Bachman and Dorothy Hovland, from Huntington Beach, CA, returned to Yosemite today to present a plaque to Park Ranger Dan Abbe to show their appreciation for his heroic efforts.  Abbe rescued the pair after their truck and trailer slid off of Highway 41 and down a steep hillside.  The plaque was presented during a ceremony in Yosemite Valley.

...The difference, of course, is fairly simple. When the Obama administration decided to bail out GM, it did not have 49 other car companies standing in line behind it. A bailout for California would establish a profound precedent. If Washington decided to underwrite Sacramento this year, it would be on the hook to do it every year. Curry Village has had the most bear activity this week with 9 incidents. Bears have been in Upper, Lower, and North Pines nightly, often before dark. If you are camping in Yosemite, please treat your bear locker like you would your refrigerator at home. Open it to get what you need, then close and latch it immediately. Stay close to any food that is out. Bears have also been seen this week around the park at Crane Flat, White Wolf, and Tuolumne Meadows.

Black bears can run up to 30 miles per hour, are great swimmers, and are very comfortable in trees.

On a daily basis, we are seeing alarming news about the pension crisis in towns and cities across the state of California and the nation. What the heck is going on? In a nutshell, while you were out living your life, your local and state politicians were making pension promises that extend many years into the future. And, in many cases, the required funding simply is not in place. To make things worse, these promises were made to our firefighters, police and other employees of the government. These are the people who make everything in a given town work.

As a budget proposal moves closer to a vote on the Senate and Assembly floors, California cities and the League continue to lobby to protect local funds from being used to close the state's $24.3 billion budget deficit. The proposed take of local gas tax funds, which total a combined $2.750 billion over the next two fiscal years, are of paramount concern to cities. A proposal to borrow local property taxes is not currently on the table, but cities need to be on alert should this proposal re-emerge.

Stanislaus National Forest Receives Economic Recovery Funding for Forest Roads Maintenance and Bridge Construction
Secretary Tom Vilsack released the national package for roads maintenance and decommissioning and associated watershed restoration on June 2, 2009.   A total of 106 roads projects, funded at more than $228 million, are located on Forest Service land in 31 states. The Stanislaus will receive $1,153,000 from this latest round of project funding.

Rewarding New Homebuyers
Working to restore a bright spot in California’s gloomy housing market, I voted in favor of a tax credit now available to new homebuyers. This tax incentive provides for a non-refundable tax credit (up to $10,000) for the purchase of a qualified principal residence.
As a result of the state and national housing crisis, new home construction and sales have stagnated.  This credit will help stabilize the housing market and motivate homebuilders to resume new home construction, which, in turn, will create new jobs.  In addition, this incentive also will stabilize the market and prevent further declines in home values.
This tax credit has been a success, with more than 9,000 Californians applying for the credit since March of this year. I’ve joined with my colleague, Senator Bob Dutton, to coauthor legislation to extend this tax incentive so we can create more jobs as we help more Californians achieve the dream of homeownership.

67 Cities Decry the State's Illegal Budget Proposals and Support Legal Action to Thwart the Unconstitutional Raids of Local Funds
Less than a week after t he League released a legal opinion from a prominent local law firm which concluded that the proposed seizure of almost $1.7 billion in city and county motor vehicle, or gas tax funds, to help close the state's budget deficit is unconstitutional, 67 cities immediately passed resolutions authorizing the city attorney to cooperate with the League, other cities and counties in pursuing litigation to have any raid of local gas tax funds declared unconstitutional and invalid. There are an additional 30 cities poised to take this same action in coming weeks with many more expected.

Ranger Dan Abbe was flagged down by park visitors south of the tunnel on Wawona Road while on his way to work in Yosemite Valley on Tuesday, May 26th. They told him that there was a truck over the side of the road and on fire, and that there were people still inside.

Maximizing the State’s Land Assets
With my background in the private sector as the owner of a successful real estate appraisal company, I’ve been chosen to lead a new Select Committee on Surplus Property. This committee will serve a timely purpose as the Governor has proposed selling seven state-owned properties, which his office estimates could bring in $1 billion.
While selling surplus properties isn’t the panacea to the current budget crisis, it does play an important role as a long-term fiscal solution. The committee will examine the surplus properties the state currently owns and develop a strategic plan for how the state should handle these properties. The committee will hold its first hearing at the State Capitol on June 25.

Barry Hance Memorial Award given in Yosemite National Park

Acting Yosemite Superintendent Dave Uberuaga announced today that Dick Ewart is the recipient of the 2009 Barry Hance Memorial Award.  Ewart, a Yosemite National Park Ranger, received the award at an all employee meeting today attended by approximately 300 people, including several past Barry Hance Award recipients.

Glacier Point Road Rehabilitation Project to Begin in Yosemite National Park
Yosemite National Park will be reconstructing part of the Glacier Point Road beginning this Monday, June 22, 2009.  Work will consist of the rehabilitation, restoration, and resurfacing of the road, including repaving and drainage improvements to include 5.1 miles of the road from the Chinquapin intersection to Badger Pass Ski area.

, the Contract Committee Staff Person for the Agricultural Nature Tourism Advisory Committee presented a Power Point Demonstration to the The Board of Supervisors and the public yesterday.
The program was about the definition and what is permitted under Ag-Nature Tourism that the committee put together over several meetings to come up with standards for the county. Not many people were present in the audience for this meeting.
The BOS after listening to Karen Robb and adding their comments advanced this to the Ag-Advisory Board who will now look at it. Then it heads to the Planning Commission and finally back to the BOS before being adopted in the county.

According to forecasters at the National Interagency Fire Center (NIFC) in Boise, Idaho, both the number and size of fires that have so far occurred this year are running well ahead of year-to-date averages for the past decade, and the prospects are that there will be above normal fire potential this summer in parts of Washington and California.

CalPERS plan to blunt effect of losses slated for vote
Without action, cities, counties and other public entities would be hit next year with large increases in their annual CalPERS contributions -- jumping from 16.9% of total payroll this July to 24.8% next July.
Under the proposal, called a smoothing policy, the public entities would pay a substantially smaller increase next year -- 19.7% of total payroll.
"By deferring pension contributions," the governor said, "CalPERS would not only be gambling that its investment earnings in this economy would grow faster than its pension obligations, but it would also be using our kids' money to do so because they would be the ones stuck footing the bill."

Crushing Blow to Local Jobs and California's Economy

The Budget Conference Committee took action yesterday to raid local transportation revenues with devastating consequences for job loss and economic recovery in the state. The action would “take” $986 million of the local share of the gas tax from the Highway User Tax Account (HUTA) to pay for general fund bond debt service in Fiscal Year 2009-10. The Conference Committee also took action to redirect $745 million of the local share in Fiscal Year 2010-11. To be clear – this action does not include paying back these monies to cities and counties. Further, there is a shared concern with the cities that this will result in a permanent loss of this local portion of the gas tax.

On May 15, 2009 Katrin Lehmann is believed to have fallen into the river below the Nevada Falls footbridge around 3:30 p.m. The 31-year-old is 6’ tall, weighs 150 pounds, has brown hair and brown eyes.

Missing Employee Found Dead in Yosemite National Park
Christopher Hale, 23, of Gainesville, Florida was found dead today in Yosemite National Park. Hale, who had been reported missing since yesterday morning was found by Park Rangers at 1:00 p.m. this afternoon. It appears that Hale fell from an unnamed cliff face above Mirror Lake in eastern Yosemite Valley. The exact cause of death and other details remain under investigation.
Hale was an employee of DNC Parks and Resorts at Yosemite, Inc., the park’s primary concessionaire. He was in training in Yosemite Valley and was slated to work at White Wolf.

Victim of Half Dome Fatality Identified
At about 3:40 p.m. on Saturday, June 13, 2009, Yosemite Emergency Communications Center received 911 calls regarding an individual who had fallen from the cables on Half Dome. Manoj Kumar, a 40 year old male from San Ramon, California, had gone to the top of Half Dome and was descending. Day time weather conditions mirrored those of the last several weeks with clouds developing midday with afternoon showers.

Surprise Tour Bus Inspection Concludes With More Violations
The previously reported surprise two-day commercial bus inspection in the park concluded last Thursday. The operation,
conducted by park staff in conjunction with the Federal Motor Carrier Safety Administration and the California Highway
Patrol, uncovered numerous violations. A total of 55 buses were inspected. On Wednesday, officers and rangers inspected
24 buses and cited 15 for unsafe operation. Another 31 buses were inspected on Thursday, with 14 cited for violations. Of
the 55 buses, five were taken out of service for problems with emergency windows, a non-functioning lever, logbooks that
had not been kept, a non-functional tire, and non-operational emergency exits. These five were from Coach America,
Franciscan Lines, Incredible Adventures, Meow Group and Bangee Fleet. Only the buses and drivers were taken out of
service – not the companies.

Half Dome Hikers Rescued

After a hiker fell to his death on a slippery wet with rain Half Dome in Yosemite National Park on Saturday June 13, 2009 many other hikers had to spend the night on Half Dome until rescue equipment could be utilized to bring some of the hikers down on Sunday morning after the weather cleared.

Will their be any accountability for the over $145,000 (And possibly a lot more) that it cost to keep Mr. Johnson off of the job? That stated dollar figure does not include any County Staff time spent on this case. County Counsel work is already included in his salary but no records are kept of staff time besides the County Counsel, on copying and filing and anything else involved in this case.

Local historian Tom Phillips,
presented a Power Point program at the Mariposa Museum and History Center on Sunday June 14, 2009 on a Tour of the Las Mariposas Grant.
Mr. Phillips through a series of photos along with engaging narrative that had many in the audience volunteering information on the 'Old Days' from stories they heard as they grew up in the county about areas that were included in the grant. Tom displayed photos from the 1860's up until as recently as 2009 depicting how the area, buildings and roads have changed over time. Tom even displayed a photo of  an encampment called Carson that was located between Mariposa and Mount Bullion. If you missed the talk, you can still purchase a hard copy of the history of the grant that Mr. Phillips has assembled into a book with all proceeds going to the Museum and History Center.

The committee rejected a Legislative Analyst's Office (LAO) proposal to borrow Prop. 42 (sales tax on gas) funds. The committee also approved the release of $700 million in remaining Prop. 1B local street and road funds, of which $258 million remains available for cities. No action has yet been taken by the committee on the Governor's proposal to borrow local property taxes under Prop. 1A. The committee also left open an LAO proposal to take half of the VLF money dedicated to local public safety.

Sac State study claims state parks pay for themselves
A team of researchers at Sacramento State University have released a new research numbers on Monday they say shows that the state parks system more than pays for itself by generating sales tax revenue.
In the face of a $24 billion budget deficit, Governor Arnold Schwarzenegger has proposed cutting all $150 million in annual general fund money to the parks system. Under the administration's plan, 220 of the state's 279 parks would be closed for at least two years.

The average 30-year rate jumped to 5.59 percent from 5.29 percent a week earlier, Freddie Mac, the McLean, Virginia-based mortgage buyer, said today in a statement. The 15-year rate averaged 5.06 percent.
Rising rates may deepen the U.S. housing slump by sidelining people who want to refinance or purchase a house. U.S. mortgage applications fell last week to the lowest since February and shares of the largest homebuilders have dropped 11 percent since May 1 on concern more expensive home loan payments will turn away prospective buyers.

Surprise Bus Inspections Conducted in Yosemite National Park
The Federal Motor Carrier Safety Administration (FMCSA), in conjunction with the California Highway Patrol (CHP), and the National Park Service (NPS) held a surprise inspection for all commercial for hire multiple passenger tour buses in the park. The purpose of these unannounced inspections is ensure visitor safety through safe operation of tour buses in an attempt to reduce chances of crashes, injuries, and fatalities involving tour buses bringing passengers to Yosemite National Park.

El Portal Burn
Preparations are being made by fire crews to burn grass in El Portal. The burning operation will be a one day project, beginning Thursday, June 11, 2009.
The atmosphere is conducive to smoke dispersal. The purpose of this burn project is to remove available fuel for defensible space. The location will be the slope behind houses between the Post Office and water tanks. Crews have been in the area this week preparing the ground by weed whacking and placing hose lines behind the homes.

Yosemite Fires – Update #10 – June 9, 2009
Another fire was found late yesterday afternoon (June 8), in the Harden Lake area. This area has a long history of lightning caused fires. A map will be sent in the next update. As stated in the last update, other fires are likely to be detected as the temperatures rise, less precipitation occurs and with longer day light hours. Pile burning has continued and over 500 of standing piles have been burned.

Mark July 28 on your calendar. That’s the date when California, the world’s eighth largest economy, goes broke – and then it gets worse. The date is set by state Controller John Chiang in a letter to the governor and leaders of the Legislature. “In the absence of legislative action, the state will not have sufficient cash to meet all of its payment obligations on July 28. By July 31, the cash deficit will increase to a negative $2.78 billion,” says Mr. Chiang in his letter.

Yosemite Valley rangers responded to a report of a motor vehicle crash involving a bicyclist on the afternoon of May 29th.  Sung Mo Ku, a 52-year-old South Korean citizen, was riding a mountain bike eastbound on South Side Drive, a two-lane, one-way road, when the accident occurred.

There have already been 7 bears hit by vehicles this year. Please obey speed limits and pay attention while drivin
g!Bears have been VERY active this spring. Bear incidents have remained high in the Yosemite Valley Campgrounds, Curry Village, and Housekeeping Camp. Additionally bears have been seen along the roads between Yosemite Village and El Capitan, wandering through picnic areas and at the base of climbing routes. Additionally in the past two weeks we have started to see backcountry incidents. If you are on a day hike do not leave your pack unattended. If you are backpacking, please carry a food storage canister.

Bears can see color, and their vision is likely equal to that of human vision. They have good night vision and can easily
move around at night. If you can see food in a vehicle, it is likely that a bear can too!

Network of Care Launch in Mariposa
On Monday June 1, 2009 the
Network of Care
website launch took place at the Government Center in Mariposa. This website is a joint venture with Mariposa County Human Services and Trilogy which owns and operates the Website.
The website is divided into eight specific areas from Domestic Violence to Public Health to a Senior Section with links to Mariposa County services and services outside of the County. Also a Library of many thousands of  health topic articles are also available.
With a small audience in attendance (that included Supervisors Jim Allen and Kevin Cann) Jacqueline Zimmer, National Sales Manager of Trilogy gave a demonstration of the Network of Care site for Mariposa County. Jacqueline mentioned that the website was built with a $2.5M grant  and that multiple counties and cities use the website with each one geared toward that city or county. 
Also included in the website is a secure section that you can use to enter in your personal information that can then be viewed only by people you want to share the information with.  This is a very welcome addition to Mariposa County as the Internet information age continues to expand in Mariposa County.

Despite the four-year run of double-digit returns, the CalSTRS chief investment officer, Chris Ailman, told the benefits committee last week that as of May 1 returns averaged 3.7 percent for the last decade and 7.5 percent for the last 20 years. Mariposa County Board of Supervisor for District 4 Kevin Cann (also retired from Yosemite Park where he was the Deputy Superintendent of Yosemite National Park) maintains that when he worked for the park, the park did not put a lot of emphasis on the winter financial numbers as the weather can play havoc with visitation. Tourism Executive Director Jeff Hentz at last Tuesday's BOS meeting said that Tourism is going through uncharted waters as some tourism areas in the United States are in crisis mode. Mr. Hentz also mentioned that the Bed Tax is down between 5-6% for the full year to year date. (May 2008- May 2009)

Despite Improving, Job Front Remains Grim

Has the job market been this bad before?
Only a handful of times since the Great Depression. The economy has shed six million jobs since the start of 2008. That's almost one out of every 20 jobs, making the current decline the worst drop in a half century. Unemployment has doubled since the start of the downturn, with 14.5 million people looking for jobs in May. The jobless rate is likely to approach, and maybe even surpass, 10% by year end.

Lassen County needs to catch lost taxable income

The Lassen County Economic Development Committee released a recent study that more than $100 million was lost out of the county to outside sources. Because of the high number of leakage the committee has formed an Ad Hoc committee of local business owners and merchants to stop the flow of dollars out of the county.

Sequoia National Park Illegal Marijuana Plantation Raided
On Wednesday, May 27th, an NPS special agent, numerous protection rangers from Sequoia and Kings Canyon, Hawaii Volcanoes, and Yosemite National Parks, Immigrations and Customs Enforcement agents, and California Department of Fish and Game wardens raided a marijuana grow site inside the southwestern boundary of Sequoia National Park.

Mariposa County Fire Benefits from Golf Tournament
On Friday, May 15th, the Mariposa County Chamber of Commerce and Greeley Hill Market hosted the 2nd Annual Gold Rush Scramble Golf Tournament at the Lake Don Pedro Golf and Country Club in La Grange.  An awards banquet dinner sponsored by A-1 Concrete followed the tournament and included a fabulous dinner, raffle, live auction, 50/50 drawing and a very entertaining battle of the bidders in a live auction ticket raffle.

The only fire continuing to show activity is the Grouse fire, which began the 30th of May and caused by lightning.

It is approximately 16 acres in size, and is near upper reaches of Grouse Creek, north of the Glacier Point Rd. and east of the Wawona Rd. This forest restoration burn will be visible (smoke and glow in the evening) throughout the "front country" part of the Park: El Portal, Hwy 120 from Foresta, and portions of the Wawona Rd. Approximately 65 firefighters are on scene. The other fires within Yosemite are in patrol status.

Construction spending posts surprising gain
WASHINGTON — Construction spending rose 0.8 percent in April, defying economists' forecasts for a decline.
The unexpected gain – the most since August – marked the second straight month that builders boosted spending on construction projects around the country, the Commerce Department reported Monday. Economists were bracing for a 1.2 percent drop in construction spending for April.
