June 30, 2026 – Modoc County District Attorney Nina Salarno announced Matthew Boldt has been held to Modoc DAanswer at preliminary hearing on numerous felony charges arising from an alleged violent assault.

The Honorable Judge Harr found sufficient evidence to hold the defendant to answer on the following charges:

  • Attempted Murder (Penal Code § 664/187(a))
  • Torture (Penal Code § 206)
  • Sexual Penetration by Force (Penal Code § 289(a)(1)(A))
  • Assault with a Deadly Weapon Likely to Produce Great Bodily Injury (Penal Code § 245(a)(4))
  • Criminal Threats (Penal Code § 422(a))
  • Corporal Injury to a Spouse or Cohabitant (Penal Code § 273.5(a))
  • False Imprisonment (Penal Code § 236)

The Court also found sufficient evidence to support multiple enhancements and special allegations, including:

  • Personal Infliction of Great Bodily Injury (Penal Code § 12022.7(a))
  • Personal Infliction of Great Bodily Injury Under Circumstances Involving Domestic Violence (Penal Code § 12022.7(e))
  • Rule 4.421(a)(3) The victim was particularly vulnerable;
  • Rule 4.421(a)(2) The defendant used a weapon during the commission of the offenses;
  • Rule 4.421(a)(11) The defendant abused a position of trust; and
  • Rule 4.421(b)(1) The defendant engaged in violent conduct indicating a serious danger to society.

The Court did not hold the defendant to answer on the charge of Mayhem (Penal Code § 203). Additionally, the Court declined to find sufficient evidence to support the special allegation of interference with the judicial process and an increasing seriousness of prior convictions.

Following the hearing, Judge Harr remanded the defendant into custody without bail. The matter is scheduled for Arraignment on the Information on July 6, 2026, where the defendant will formally enter pleas to the charges on which he has been held to answer.

As with all criminal cases, the defendant is presumed innocent unless and until proven guilty beyond a reasonable doubt in a court of law.
